CLIENTS AND COLLEAGUES PRIVACY

This privacy policy sets out how Modh Design Ltd uses and protects any information that you give Modh Design Ltd when you work with us as your Architects or Design Consultants. Modh Design Ltd is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified, then you can be assured that it will only be used in accordance with this privacy statement. Modh Design Ltd may change this policy from time to time by updating this document.

What and how information collected

We collect data from visitors to this website using WIX analytics and the contact page when you email us with an enquiry to hello@modhdesign.co.uk or via a telephone enquiry. We also collect your details when we met you in person following our initial consultation. If you are a client or contractor, when you submit your data to us by email, in person, over the phone, or other, this is collected and is used by us in a variety of ways. We take your privacy very seriously and we will have your data stored in several other places for the purposes of invoicing along with statutory and legal requirements to deliver your project, including the following:

  • Internal record keeping.

  • Working alongside the relevant consultants for your project

  • Local Authority Planning, Building Regulations application submissions etc

  • Construction Design Management Pre-Construction Documents

  • Tendering submission packages

  • Building Contract Documents

  • Providing and personalising our services

  • Dealing with your enquiries and requests

  • Sending email submission confirmation, contract communications, account statements and order tracking.

  • We may use your information i.e. photos or drawings for our own advertising purposes via awards submission, website, Facebook or other social media, brochures or presentation to prospective client but all following a written consent request to you.

In all cases, our aim is that it is clear what you are opting into and you will have given your consent for us to use your data and the data we gather, process and store is a legitimate interest to do so, in order to commission a project, and answer enquiries, communicate and coordinate personnel. More generally, we do not pass on your data to any third party without consent or knowledge, other than the aforementioned stated within our legal obligations to deliver a project. If you would not like us to pass on your data, please email hello@modhdesign.co.uk or if you have any concerns, request the disclosure, rectification, erasure of held personal data or if you have any issues pertaining to your rights of your data under GDPR, for you or your organisation, then please do not hesitate to contact us immediately. From time to time, we may also use your information to contact you for our own market research and service feedback purposes and you can request to opt out at any time by contacting us or with verbal instruction.

 

RETENTION OF DATA

The RIBA recommends that all drawings, models, information, data and correspondence should be retained from initial contact with the client through to the end of the limitation period (6 or 12 years post contract/practical completion) and any limitation extension. This is to be able to respond to any legal claim or similar and is therefore the legitimate interest of us to ensure your data is retained for the necessary duration. As required under the ARB Code of Conduct (ARB 2017), we “ensure that adequate security is in place to safeguard both paper and electronic records for (our) clients, taking full account of data protection legislation, and that clients’ confidential information is safeguarded.”

HOW AND WHERE YOUR DATA IS STORED

We are committed to ensuring that your information is secure, your data is stored includes names, email addresses, telephone numbers and postal address which is stored on our Outlook account and is also backed up on multiple remote hard drives, as well as paper copies that are stored within locked filing cabinets, within an alarmed premises. The digital files are stored on Outlook, which is the data processor and Modh Design Ltd is the data controller. Outlook is a security-hardened cloud-based online data storage subscription service. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. We have regular IT support and maintenance to ensure all protection of your data is reasonably in place, ensuring work computers are secured using the latest antivirus software.

CONTROLLING YOUR PERSONAL INFORMATION

We will not share your data with third parties unless we are obliged to disclose personal data by law, or the disclosure is necessary for purposes of national security, taxation and criminal investigation, or we have your consent. Please be aware that planning application information is open to the public to view and comment on however we can pre-agree to omit applicant names where requested. If you have any concerns, please see your local authority’s privacy policy. You have the right to see the data we have collected about you. If you have any requests concerning your personal information or any queries regarding these practices, please contact us at hello@modhdesign.co.uk. You may choose to restrict the collection or use of your personal information and your rights under the GDPR enable you more control of the data we hold on you or your organisation, such as rights to disclosure, access, rectification, erasure, restriction of processing, data portability and rights to object. Data gathered on our website is for website enquiry purposes only via our contact page, which is subsequently sent to our emailing system for actioning. If you have previously agreed to us using your personal information for direct marketing purposes and have changed your mind, or if you have any concerns or with to exercise your rights to access or erase for example, you may instruct us so by communicating your wishes in writing or emailing us at hello@modhdesign.co.uk. We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.
